bob, good morning. >> reporter: and what is still happening. good morning, jon. this is a custody hearing to determine if those three 16-year-old boys should continue to be detained at a juvenile center in san jose. this is where they have been since their arrest this past thursday or if they should be allowed to be going back home with their families. the family of audrie pott, she is the 15-year-old girl they are accused of sexually assaulting, that family is determined to make sure they do stay behind bars. this morning pott's parents, stepmother and lawyers attende the hearing. it's not clear what, if anything, they were able to say before the judge since these proceedings are closed to the public and the media. we also don't know what the judge will decide. we'll get a better idea when the potts speak to us after it's over. it's highly unlikely for the boys to be arraigned, it usually takes place 10 days after the initial hearing. during a news conference pott's parents and stepmom said they are filing a wrongful death as a result of her suicide. she killed
